Please read these Terms of Service ("Terms") carefully before using the BlueMonkeyAI service operated by Bizitel Limited ("we", "us", or "our").
1. Acceptance of Terms
By accessing or using our AI receptionist service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
BlueMonkeyAI provides an AI-powered receptionist service that:
- Answers incoming telephone calls on behalf of your business
- Handles enquiries using your customised knowledge base
- Books appointments and sends confirmations
- Transfers calls to designated staff members
- Provides call recordings and analytics
3. Account Registration
To use our service, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Be responsible for all activities under your account
4. Subscription and Payments
Billing: Subscriptions are billed monthly in advance. Additional usage beyond your included minutes is billed at £0.25 per minute.
Payment: Payment is due upon subscription and on each renewal date. We accept major credit cards and direct debit.
Price Changes: We may change our prices with 30 days' notice. Continued use after the price change constitutes acceptance.
Refunds: We do not offer refunds for partial months or unused minutes. You may cancel at any time to prevent future charges.
5. Acceptable Use
You agree not to use our service to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm others
- Transmit spam, unsolicited communications, or fraudulent content
- Impersonate any person or entity
- Interfere with or disrupt the service or servers
- Attempt to gain unauthorised access to any systems
- Use the service for any illegal or harmful purpose
- Record calls without proper consent where required by law
6. Your Responsibilities
You are responsible for:
- Ensuring your use of the service complies with all applicable laws
- Informing callers that calls may be recorded (where required by law)
- Providing accurate information for your AI receptionist's knowledge base
- Reviewing and approving your AI receptionist's responses
- Maintaining appropriate backup communication channels
7. Intellectual Property
The service, including its original content, features, and functionality, is owned by Bizitel Limited and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any content you provide (e.g., knowledge base content, business information). By providing content, you grant us a licence to use it to provide the service.
8. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any downtime or service interruptions due to:
- Scheduled maintenance (with reasonable notice)
- Emergency maintenance
- Third-party service failures
- Events beyond our reasonable control
9. Limitation of Liability
To the maximum extent permitted by law:
- Our service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not liable for any missed calls, incorrect information provided by the AI, or business losses
10. Indemnification
You agree to indemnify and hold harmless Bizitel Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you provide to the service
11. Termination
By You: You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or engage in conduct that harms the service or other users.
Effect of Termination: Upon termination, your right to use the service ceases immediately. We may delete your data after 30 days following termination.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bizitel Limited regarding the service.
